Appendix A – Terms & Conditions of Entry

Entrants must be over 18 years of age and resident in the UK. Free activity break holiday options include either; a free UK weekend break, or a free Austrian ski-weekend break for one person, based on those events offered on our website only. Free holiday offer subject to availability and free holidays must be taken before the end of 2013. How to enter, simply email; info@activitybreaks.co or info@skibreaks.co quoting free holiday competition. Draws will be made November 12th 2012 at 12noon. Winners will be contacted by email and telephone, plus winners details will be published on our website. By entering into this competition entrants agree to be contacted by our team if they are the winner and their name placed on our website for other entrants to see. All entrants agree to Activity Breaks and Skibreaks contacting them by email with holiday event details. Any entrants not wishing to be contacted by our company only need reply to our email with the phrase ‘please remove me from your mailing list’ and we will not email again. All entries will be placed in one large container, the competition winner will be drawn from that container by an individual who has not entered and is not a member of our company and this will be independently verified.

Activity Breaks and Ski Breaks (Cheshire) Ltd Booking Agreement
Please read the following booking conditions and important information before booking your holiday. Your booking contract is with ACE Ltd, parent company of Activity Breaks and Skibreaks, whose registered office is 14 Church Street, Malpas, Cheshire, SY14 8NU
1. Your Holiday Booking. You must check your booking confirmation email carefully and raise any concerns or questions with our office immediately. Your contract is with ACE Ltd and we reserve the right to cancel or refuse to accept any booking at any time.
2. Free Holiday Winners – your free holiday will consist of a free placement on one of our long-weekends in the UK or long-weekend ski trips to Austria, where we will provide half-board accommodation, airport transfers (if you choose Austria) and an Activity Breaks host. Each free holiday winner will be responsible for booking and paying for their own flights, equipment rental, lift-pass and insurance.
3. If You Alter Your Confirmed Booking. If you wish to alter or transfer your booking to another date or holiday after we have sent you our confirmation email you must contact us by phone or email with details of the alteration requested. If it is less than 28 days prior to departure you may be required to pay costs arising from the alteration. If there are no alteration costs we will not charge you.
4. Cancellation Policy. You should ensure you organise your own insurance for the activity or event you are booking. Ensure your insurance policy covers you for certain events leading to cancellation, which may include; flights, rail or other travel expenditure you may incur. Please note that we cannot control airlines, rail companies, etc which is why you require a level of insurance. Your insurance policy also needs to cover you for the activities you are participating in, bearing in mind skiing, snowboarding, surfing, hiking, biking and other events do carry a level of risk. 5. Transferring a Booking. If you are unable to travel, in certain circumstances, which we consider reasonable, we may allow you to transfer your booking to another person.
6. What Is Included In Your Holiday. The services of a host or Local Representative, Hotel accommodation and half board where stated in your booking. Transfers between airport and hotels in resorts are included please see individual events for full details.
Not Included: Holiday Insurance, activity insurance, wintersports insurance, personal expenses (drinks, laundry etc), flights (unless otherwise stated).
8. If You Have a Special Request. If you have a special request or dietary needs please inform us in writing, by phone or by email, which include your eating preferences, Vegetarian or other dietary requirements. We will do our best to comply but we cannot guarantee to do so.
9. If You Have A Complaint. If you have cause for complaint whilst on holiday, this must be brought to the attention of our host or Local Representative immediately so that action can be taken to remedy the problem. Failure to report your complaint to the Tour Manager or Local Representative whilst in resort will jeopardise any claim.
10. If We Alter Your Booking. We aim to provide the holidays described on our website. However we may occasionally have to change your holiday arrangements or part of them. We reserve the right to do so. If changes or alterations are required we will do our best to notify you before departure.
11.If we Cancel Your Holiday. Cancellation may be necessary in exceptional circumstances and we reserve the right in its absolute discretion to cancel your holiday. If this occurs you will be offered an alternative holiday of comparable standard (if available) or a refund. We cannot and will not pay any compensation, nor be responsible for any costs or expenses incurred by you as a result. Circumstances outside of our control include but are not limited to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions.
12. Minimum Numbers. Each of our trips is based on a minimum number and we reserve the right to cancel a tour if such numbers are not reached. You will then have the choice of booking an alternative holiday with us, changing your departure date, or to receive a full refund.
13. Website Accuracy. Every care is taken to ensure that information on our website is correct and accurate. However we cannot guarantee that all information on our website is correct as placements available change daily, flights are subject to variation, weather plays a part in many activities, etc.
14. Itineraries. We make every effort to adhere to the itinerary we send out. However it should be understood that changes may be necessary once the holiday has commenced due to influences such as weather, transport or other conditions.
15. Inappropriate Conduct. Any person considered to be behaving in an antisocial manner and/or under the influence of alcohol or drugs may be refused boarding or removed from any flight or event.
16. Our responsibility for your personal safety. Activity Breaks accepts responsibility for matters arising directly from our negligence and/or our duty to exercise reasonable care in arranging the activity based holiday. We cannot be held responsible or liable for death, injury or illness suffered by you unless this is through Activity Breaks direct negligence based on the actual elements of your holiday that include accommodation, airport transfers and our host. However, you participate in each of our activities at our own risk. Each of our suppliers, agents and events teams in resorts carry their own qualifications and insurance relevant to that resort and their countries legislation which may not necessarily be the same requirements as in Great Britain. Note: It is your responsibility to notify Activity Breaks of any existing medical, physical or mental conditions that you have, taking part in any activity is at your own risk and this risk can be increased if you have an existing known condition or if you do not have the required physical ability to participate in selected activities. You are required to organise you own insurance to cover your holiday, repatriation if required and to cover the specific activities you are participating in, including winter sports.
17. Delays. Regrettably we cannot guarantee that your flight, rail or other transport will not be subject to delay. Whatever the nature of a delay, these are the responsibility of the carrier, and subject to their Conditions of Carriage.
17. Data Protection Policy. In order to process your booking, ensure that your travel arrangements run smoothly, and that they meet your requirements, we need to use the information you provide, such as name, address, mobile telephone number etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass this on to relevant suppliers of your travel arrangements, such as airlines, hotels, transport companies, etc. The information may also be provided to security or, public authorities such as the police or customs/immigration, if it is required by them, or as required by law. When making this booking, you consent to this information being passed on to the relevant persons.
18. The data protection act. We are registered in the UK and comply with the data protection legislation. We will not sell, rent or trade your personal information to any third parties without your permission.
